Currently, the Model Code of Conduct is in force given elections in Maharashtra and Jharkhand. Under this, hoardings, banners, posters of political parties, and promotional material of government schemes have been removed from public places. This ban can range from a few hours to a few days.
Warnings and notices
The first reaction to violation of the code of conduct is a warning or notice. The commission takes cognizance of the matter and gives the concerned person or party an opportunity to improve.
Ban on election campaigning
If the violation is serious, strict restrictions are imposed on campaigning. This forces the candidate or party to stop their campaign activities.
Cancellation of electoral nomination
Considering the severity of the violation of the code of conduct, the Election Commission can also cancel the election nomination. If a candidate has distributed illegal money or liquor to influence voters, his nomination can be canceled.
Fines and penalties
Many times, fines and financial penalties are also imposed on violators. This penalty depends on the severity of the violation.
Prison sentence
Officially, jail sentences are also provided for some serious violations, such as election violence or making inflammatory speeches. In such cases, the candidate can be sentenced to up to 2 years.
